These Terms of Use ("Terms") govern your access to and use of the WhoWins website at whowins.dev (the "Service"), operated by WhoWins ("we", "us", "our"). By using the Service, you agree to these Terms.
Nature of the Service
WhoWins is an independent fan-vote platform provided for entertainment purposes only. Results reflect self-reported fan votes and are not an official prediction, forecast, endorsement, sports analysis, or betting product. We do not accept wagers.
Eligibility
You must be at least 13 years old to use the Service (16 in the European Economic Area). By using the Service, you represent that you meet this age requirement.
Acceptable use
- Vote in good faith and do not attempt to automate, script, or manipulate voting.
- Do not attempt to bypass, disable, or interfere with the Service's security or anti-abuse features.
- Do not use the Service to harass, defame, or harm others.
- We may, at our discretion, filter or discard votes we determine to be automated, duplicative, or otherwise abusive, without notice.
Intellectual property
All site content, including layout, copy, artwork, and the WhoWins name and logo, is owned by WhoWins or its licensors and is protected by intellectual-property laws. Country flags are used solely for national identification and remain the property of their respective jurisdictions. All original artwork is created for WhoWins.
No affiliation
WhoWins is not affiliated with, endorsed by, or sponsored by FIFA, UEFA, either national team, any player, any tournament organizer, or any broadcaster. All third- party names and marks referenced editorially remain the property of their owners.
Third-party links
The Service may link to third-party websites (prediction markets, broadcasters, news outlets). These links are provided for information only. We do not control and do not endorse third-party sites; your use of them is at your own risk and subject to their own terms.
Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or availability. We do not warrant that the Service will be uninterrupted, secure, or error-free.
Limitation of liability
To the maximum extent permitted by applicable law, WhoWins will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service. Our total aggregate liability for any claims arising out of these Terms or the Service is limited to one hundred U.S. dollars (US$100).
Indemnity
You agree to indemnify and hold WhoWins harmless from any claim, damage, or expense arising out of your misuse of the Service, your violation of these Terms, or your violation of any third-party right.
Changes to the Service and Terms
We may modify or discontinue any part of the Service at any time. We may update these Terms; material changes take effect when the "Last updated" date at the top of this page changes. Continued use of the Service after changes constitutes acceptance.
Governing law
These Terms will be interpreted under applicable law of your country of residence to the extent required. Nothing in these Terms limits any mandatory consumer rights that apply to you and cannot be waived by contract.
